Welcome to DataConverter.io! These Terms of Use (“Terms”) govern your access to and use of the DataConverter.io website and services (the “Service”). By using our Service, you agree to these Terms. If you do not agree to these Terms, please do not use our Service.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as any applicable laws and regulations. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

2. Modifications to Terms

We reserve the right to modify or update these Terms at any time. If changes are made, we will notify you by posting the updated Terms on our website or by sending an email to registered users. Your continued use of the Service after any changes means you agree to the revised Terms. It is your responsibility to review these Terms periodically.

3. Eligibility

To use DataConverter.io, you must be at least 16 years old or have reached the age of majority in your jurisdiction. If you are under the age of 16, you may not use the Service. By using the Service, you represent that you meet these eligibility requirements.

4. Account Registration

To access certain features of the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials, and you agree to notify us immediately if you suspect any unauthorized use of your account. You are fully responsible for all activities that occur under your account.

5. Service Use

5.1 License Grant

DataConverter.io grants you a limited, non-exclusive, non-transferable, revocable license to use the Service, subject to these Terms.

5.2 Restrictions

You agree that you will not:

• Use the Service for any unlawful or fraudulent purposes.
• Attempt to reverse engineer, decompile, or otherwise attempt to extract the source code of the Service.
• Use the Service in a way that could damage, disable, or impair the Service.
• Share your account credentials with others or allow others to use your account.
• Use the Service to upload or distribute any content that infringes on another's intellectual property rights.

5.3 Suspension and Termination

We may suspend or terminate your access to the Service at any time without notice if you violate these Terms or engage in any behavior that we deem harmful or abusive. In such cases, we may also delete any data associated with your account.

6. Fees and Payments

6.1 Subscription Plans

DataConverter.io offers various subscription plans. By purchasing a subscription, you agree to pay the applicable fees and any related taxes. All payments are non-refundable, except as provided in our Refund Policy (see Section 7).

6.2 Payment Processing

Payments for subscriptions are processed by third-party payment processors. By subscribing to a plan, you authorize us to charge the applicable fees through these payment processors. DataConverter.io does not store your payment information.

6.3 Auto-Renewal

Your subscription will automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date. You can manage your subscription and payment details through your account settings.

7. Refund Policy

If you are not satisfied with the Service, you may be eligible for a refund as described in our Refund Policy. Refund requests must be submitted within 5 days of purchase. Refunds are granted at our sole discretion and may be subject to certain conditions.

8. Intellectual Property

8.1 Ownership

All content, software, and materials available on DataConverter.io, including but not limited to text, graphics, logos, and code, are the intellectual property of DataConverter.io or its licensors. You may not use, copy, or distribute any such content without our prior written consent.

8.2 User-Generated Content

By uploading, submitting, or otherwise making content available on the Service, you grant DataConverter.io a non-exclusive, worldwide, royalty-free, fully paid-up license to use, reproduce, modify, display, and distribute such content for the purpose of providing the Service. You represent that you have all necessary rights to grant this license and that your content does not violate any third-party rights.

9. Data Protection

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our collection, use, and disclosure of your data as outlined in the Privacy Policy.

10. Disclaimer of Warranties

The Service is provided on an “as-is” and “as-available” basis. DataConverter.io makes no warranties, express or implied, regarding the availability, accuracy, or reliability of the Service. We do not guarantee that the Service will be error-free or uninterrupted.

To the fullest extent permitted by law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, DataConverter.io shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of your use of or inability to use the Service.

In no event shall our total liability exceed the amount you have paid to us for the use of the Service in the past 12 months.

12. Indemnification

You agree to indemnify, defend, and hold harmless DataConverter.io, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including legal fees, arising out of or in connection with:

• Your use of the Service.
• Your violation of these Terms.
• Any claim that your content violates the rights of any third party.

13. Governing Law and Dispute Resolution

These Terms and any disputes arising out of or related to the Service shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles.

13.1 Arbitration

Any disputes arising out of or in connection with these Terms shall be resolved through binding arbitration in the Province of Ontario, Canada. You agree to waive the right to trial by jury and to participate in a class action.

14. Changes to the Service

We may update, modify, or discontinue the Service or any part thereof at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Service.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with the Privacy Policy and any additional agreements you enter into with DataConverter.io, constitute the entire agreement between you and DataConverter.io concerning your use of the Service.

15.2 Severability

If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will continue to be in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision.
